Please read below for the condo and resort rules, terms, and conditions.

TERMS & CONDITIONS

Our goal is to provide a seamless, elevated experience at Sonoran Star 2-802. The following terms are designed to protect both our guests and our home, so that every stay remains safe, respectful, and enjoyable. By booking with us you agree to all of the terms and conditions found here as well as the Condo Rules and Resort Rules found below. If you have any questions, please reach out to us.

SONORAN STAR 2-802 CONDO RULES

CANCELLATION POLICY

100% refund (minus the 3% credit card processing fee) up to 7 days before check in. After that period, the deposit will be able to be used for future stays, but is not refundable.

SONORAN STAR COOLER POLICY

Small/personal coolers may be used within the common areas of the resort by homeowners, renters, and guests. ABSOLUTELY NO GLASS IS ALLOWED IN THE POOL AREAS/COMMON AREAS/ON THE BEACH. During Pool Bar operating hours, personal coolers and outside alcoholic beverages will not be permitted within the Pool Bar area. During this time, all beverage service in that area must be purchased through the Pool Bar. After the Pool Bar closes, the Pool Bar area will also be open for use with small/personal coolers. In the family pool areas, alcoholic beverages may not be consumed inside the pools under any circumstances. Alcohol consumption is permitted within the surrounding seating and common areas only. Coolers of any size may be transported through the resort common areas for use on the public beach; however, only small/personal coolers are permitted for use within the resort common areas themselves. Visible signage will be placed in the family area to help communicate and reinforce these guidelines. In order to maintain a safe, family-friendly, and enjoyable environment for everyone, intoxication, excessive alcohol consumption, or unruly behavior will not be tolerated. Administration and security reserve the right to ask individuals involved in inappropriate behavior to leave the common areas temporarily if necessary. See below for a zone map of where personal coolers are allowed.

Liability & Risk Allocation Provisions

1. Reservation & Acceptance By completing a reservation, or accessing the Property, you (“Guest”) acknowledge that: You have read and understand these Terms & Conditions You agree to be legally bound by them You accept responsibility for all occupants and invitees associated with your reservation 2. Acknowledgment of Risk Guest understands that the use of a privately owned beachfront condominium and resort amenities involves inherent risks, including: Slips, trips, and falls (including balconies, tile flooring, wet surfaces) Swimming pool and ocean-related hazards Use of appliances and furnishings Actions of other guests or third parties Guest voluntarily assumes all risks associated with occupying the Property.  3. Guest Responsibilities Guest agrees to: Supervise minors at all times Use the Property and amenities safely and responsibly Comply with all Sonoran Star Resort rules, HOA regulations, and posted signage Ensure all occupants adhere to these Terms Failure to comply may result in immediate removal without refund. 4. Property Condition The Property is privately owned and provided “as-is.” While we take great care to maintain the unit, availability of utilities, services, or amenities cannot be guaranteed. 5. Release of Liability To the fullest extent permitted by applicable law, Guest, on behalf of themselves and all occupants: Releases and holds harmless the Owner, managers, and affiliates from any claims related to: Personal injury or death Loss or damage to personal property Use or occupancy of the Property or resort Waives the right to bring claims arising from ordinary negligence, where permitted by law  6. Indemnification Guest agrees to indemnify, defend, and hold harmless the Owner from all claims, damages, and expenses (including attorneys’ fees) arising from: Guest’s use of the Property Violations of these Terms Injury or damage caused by Guest or their invitees 7. Damage & Financial Responsibility Guest is responsible for: Damage to the unit or common areas beyond normal wear Missing items or excessive cleaning Fines imposed by the resort or HOA due to Guest conduct 8. Personal Property Disclaimer Owner is not responsible for loss, theft, or damage to Guest belongings. Guests are encouraged to obtain personal insurance coverage. 9. Interruptions & Force Majeure Owner shall not be liable for circumstances beyond their control, including: Weather events Utility outages Government actions or travel restrictions No refunds or liability shall apply to such events. 10. Medical & Emergency Acknowledgment Guest acknowledges that: Medical services in Mexico may differ from those in the United States Emergency response times and care standards may vary Guest assumes full responsibility for obtaining medical care 11. Insurance Notice Short-term rental risks may not be fully covered by standard policies. Guests are encouraged to obtain travel and liability insurance for protection during their stay.  12. GOVERNING LAW & JURISDICTION (CRITICAL SECTION) This Agreement is intentionally drafted to address the cross-border nature of the Property: Primary Governing Law This Agreement shall be interpreted under the laws of the State of Arizona, without regard to conflict of law principles. Location of Property Guest acknowledges that the Property is physically located in Sonora, Mexico, and that: Mexican laws may apply to events occurring onsite Local authorities and jurisdiction may govern incidents occurring within Mexico Forum Selection To the maximum extent permitted: Any dispute related to contractual terms, booking, payment, or liability waivers shall be resolved in Maricopa County, Arizona Guest expressly consents to personal jurisdiction in Arizona courts for such disputes 13. LIMITATION OF LIABILITY To the fullest extent permitted by law: Owner’s total liability, if any, shall not exceed the amount paid for the reservation Owner shall not be liable for indirect, incidental, or consequential damages 14. SEVERABILITY If any provision of these Terms is found unenforceable, all remaining provisions shall remain in full force and effect. 15. ENTIRE AGREEMENT These Terms & Conditions constitute the entire agreement between the parties and supersede any prior communications or representations.

RESORT RULES

Community Rules and Use of Amenities Substance Use  Smoking, vaping, or consuming drugs or illegal substances is strictly prohibited within units and common areas.  Non-compliance will result in an initial warning. Continued violations may be reported to the appropriate authorities. Public Conduct  Nudity, exhibitionism, or inappropriate behavior on balconies, pools, or common areas is strictly prohibited. Pool Rules  Pools are for exclusive use of registered owners and guests.  Hours: 10:00 a.m. to 10:00 p.m.  Showering before entering is mandatory.  Proper swimwear is required; cotton clothing, denim, or inappropriate attire is not allowed.  Running or diving is not permitted.  There is no lifeguard; use is at your own risk.  Children under 12 must be supervised at all times by a responsible adult.  Audio devices must be used with headphones only.  The resort is not responsible for unattended personal belongings.  Glass items or sharp objects are strictly prohibited. Gym Rules  Hours: 6:00 a.m. to 10:00 p.m.  Exclusive use for registered owners and guests.  Wristband must be worn at all times.  No access without prior registration.  No access for individuals under 16 years old.  Ages 16–18 must be accompanied and supervised by a responsible adult.  Proper athletic clothing and closed-toe shoes required.  Clean equipment after use.  Return weights and accessories to their place.  Do not reserve equipment.  Avoid excessive noise or disruptive behavior.  No food or alcoholic beverages allowed.  Only closed containers or sports bottles permitted.  Speakers are not allowed.  Personal devices must be used with headphones.  TV volume must remain moderate.  Noise should not be heard outside the gym.  Use equipment at your own risk.  Dropping weights or equipment is prohibited.  Any damage or unsafe condition must be reported immediately to Security or Administration. Noise and Coexistence  To maintain a harmonious environment, noise levels must not exceed 50 decibels.  Due to proximity to a public beach area, external noise may occur and is beyond the control of resort administration.
